The Legal Forum for the Land of Israel Petitions Israeli Supreme Court to Stop Construction Freeze (11.30.2009)

November 30, 2009, JERUSALEM - The Legal Forum for the Land of Israel has appealed to the Israeli Supreme Court to stop the 10-month freeze on Jewish building in the disputed territory of Judea and Samaria ("the West Bank").

The Forum's petition states that the Government did not go through the proper procedure in approving the freeze since only a part of the Cabinet - what is known as the "Security Cabinet" - was convened to approve the move.

In the Forum's appeal, attorney Yossi Fuchs wrote that "[a] decision likely to bring serious harm to the assets of Israeli citizens and is unrelated to security cannot be made in an underhanded, covert way, by a secret security cabinet or predetermined without any chance for ministers to appeal."

"The mini-Cabinet did not even claim that this was a security decision, but rather stated vaguely that its purpose is to encourage the renewal of talks with the PA," Fuchs said.

The announcement of the freeze came on November 22, 2009, after months of sustained pressure from the Obama Administration to "end settlements."
